COURT POSTPONED AGAIN...
A BC Supreme Court Judge has set the next court date for January 22, 2008.
The BC Attorney General's office has interviened in this case, overshadowing the City of Victoria, and now claim that they must postpone the case while they review the evidence. The fact that 2 years has passed reflects upon government's attempts to avoid bringing the city bylaw under the scrutiny of the courts. Lawyers representing the homeless served the City of Victoria, Province of British Columbia, and the Nation of Canada with notice of the constitutional question, on time and in accordance with legislation.
Now the Attorney General's office is trying to have the court case dismissed, much like the City of Victoria's failed attempt in August. The province is attempting to use a technicality to going to strike the entire case in court on October 30th and 31st but lawyers for the homeless are confident this will fail and the case will go to trial in January.
